Booking Policy

The right to access and use the rented Cottage

Tenant access to the Cottage and Property shall be granted no earlier than 2:00 p.m. on the Commencement Date and shall end no later than 12 noon on the Termination Date.

Common Areas

The right to access and use the Common Areas on the Property.

Parking

The right to access and use a secured parking space on the Property for each Cottage rented.

Cancellation policy

For cancellation up to one week before your stay, we will fully refund your booking fee (minus roughly EUR 5 charge processing fee charged by PayPal).

For cancellations up to 2 days before your stay, we will refund 50% of your booking fee.
For cancellations with less than 48 hours’ notice, we will not refund any amount of your booking fee.

Obligations of the tennant

Residential Use Only

The tenant shall use the Property only for residential purposes.

Self Catering Cottage

The Tenant acknowledges that it is aware that this is a Lease for a self-catering cottage and not a hotel.
For the avoidance of doubt, this means that no meals will be provided by the Landlord to the Tenant during the Term.
At the start of the Term, the Landlord will provide the Tenant with use of the Cottage which includes:

  • a full kitchen with necessary appliances and utensils for the Tenant to prepare their own meals;
  • bedrooms with clean linens and pillows;
  • bathrooms with towels, soap and toilet paper and
  •  a free “welcome basket” of chips and snacks which is provided in each Cottage at the start of the Term at no charge.

.We do NOT offer restaurant facilities on site. Other than the breakfast which is included in the booking fee, it is the Tenant’s obligation to supply their own meals while at Jardine Hills.

We do not clean the cottages or change the linens during the Term. If at any time during the Term the Tenant would like fresh linens or towels these can be changed out and supplied by the Landlord but at an additional cost of EUR 15 per Cottage per change.

Quiet Enjoyment

The Tenant shall maintain noise levels (including music) at a reasonable level and not disturb the quiet enjoyment of other tenants in the Cottages or neighbors to the Property. No access to the pools, Jacuzzi, barbeque or play areas is allowed between the hours of 12 p.m. and 8 a.m.
Interior of the Premises.

The Tenant shall use reasonable care with respect to all furnishings, technical equipment, heating and cooling, televisions, appliances, etc. in the Cottage. The Tenant shall be fully liable and immediately reimburse the Landlord for any damages, loss, or theft of any interior items during the Term.

The exterior of the Premises

The Tenant shall use reasonable care with respect to all exterior facades, windows, finishing, etc. in relation to the cottages and the Common Areas.

Pools and Jacuzzi

The Tenant shall use reasonable care with respect to the pools and Jacuzzi. The use of breakable glassware, bottles, or dishes is strictly prohibited in the pools and Jacuzzi areas. The Landlord shall not be liable for any accidents or harm that the Tenant or its guests may experience while using the Common Areas, including (but not limited to) the pools, Jacuzzi, play area, and barbeque area. The Tenant shall be fully liable and immediately reimburse the Landlord for any damages, loss, or theft of any Common Area items or furnishings during the Term and any cleaning, draining, or repairs to the pools or Jacuzzi areas resulting from the Tenant’s use of breakable glassware or dishes in these areas in breach of this Lease.

Limit of People Per Cottage

The Tenant shall identify to the Landlord in writing the names of those persons who will occupy the Cottage under the Lease agreement during the Term.
No more than one (1) family may occupy one cottage. A family means no more than two adults and two children. A family with more than two children
may occupy one cottage provided that no more than two children of these children are older than thirteen (13) years of age.
Alternatively, no more than two (2) couples (or four (4) non-related adults) may occupy one cottage.
Please note that these are strict limitations imposed upon the Landlord by the Romanian Ministry of Tourism and any violation of these occupancy limitations may lead to the Tenant’s immediate eviction without refund.
Day guests of the Tenant are permitted to visit the Tenant at the Property and to access the Cottages and Common Areas only upon prior consent being obtained from the Landlord and provided that: the day guests comply with all Tenant obligations hereunder; no day guest may spend the night in the Cottage.
The Tenant remains fully liable and shall immediately reimburse the Landlord for any damages, loss or theft caused to the Property by its guests.
Violation of these limitations may lead to the Tenant’s immediate eviction without a refund.

Entry by Landlord

The Tenant allows the Landlord (and those authorized by it), at reasonable hours and with prior notice, to enter the Premises for the purposes of (1) maintenance, cleaning, decoration, alteration, replacement, and repair of any part of the Property, (2) inspection of the Property, (3) compliance with any law, (4) compliance with this Lease or (5) for the provision of any services. Following reasonable notice, or in an emergency, the Landlord may immediately access the Property.

Compliance

To comply promptly and diligently with (1) applicable law, (2) the Landlord’s regulations from time to time for management or use of the Property, (3) recommendations and maintenance manuals relating to the Property and any machinery or equipment on the Property, (4) any requirement or recommendation of any insurer and (5) any requirement or recommendation of any fire or similar authority relating to access, equipment or apparatus. To comply with the Landlord’s requirements concerning the regulation of noise, fumes, temperature, and other matters to ensure that other tenants of the Property are not disturbed.

Activities

Not to do anything on, or bring anything into, the Cottage or Property which causes or may cause (1) a nuisance, annoyance, injury, or damage to the Landlord or any other tenant or occupier of the Property, (2) noise or vibration which can be heard or felt in any other premises on the Property or outside the Property or (3) use any noxious or deleterious substance to damage or obstruct any part of the Property or pollute the air or water. The Tenant shall not hold any large or noisy parties or gatherings at the Property and covenants to the Landlord that it will take all prudent measures, and exercise all reasonable standards of care, to eliminate the risk of fire, explosion, or other damage which may arise as a result of the use of the Property.

To indemnify the Landlord on demand for all losses and costs incurred in procuring compliance by the Tenant (or attempting to do so) with the terms of this Lease, including any direct or indirect costs incurred by the Landlord upon the termination of the Lease (and any court procedure).

Return of Premises

On the expiry of the Term, or earlier termination, of this Lease, to return the Property to the Landlord (1) in the same condition as at the Commencement Date (normal wear and tear excepted) and consistent with the Tenant’s obligations under this Lease, (2) cleaned and free of any equipment, personal items and refuse, and (3) together with all keys and any equipment and other items which are the property of the Landlord or which are affixed to the Property.

Rights of the landlord

All legal rights of ownership of the Property remain vested with the Landlord.
To immediately terminate this Lease and evict the Tenant or any of its guests, should they fail to observe the Tenant Obligations.

To deny access to the Premises or to evict from the Property any Tenant or Tenant guests whom, in the Landlord’s discretion, are boisterous, disruptive or otherwise not complying with the provisions of this Lease.

To enter the Property (or instruct those authorised by Landlord), at reasonable hours and with prior notice, for the purposes of (1) maintenance, cleaning, decoration, alteration, replacement and repair of any part of the Property, (2) inspection of the Property, (3) compliance with any law, (4) compliance with this Lease or (5) for the provision of any services. In an emergency, the Landlord may immediately access the Property without need of notice to the Tenant.

Obligations of the landlord

Warranties concerning the Property

The Landlord warrants that, as at the date of this Lease, it is the sole owner of the Property and has the power and authority to enter into this Lease. The Landlord further warrants the free and unobstructed access to the Property by the Tenant.

Quiet enjoyment

So long as the Tenant complies with its obligations under this Lease, the Landlord does not interrupt the Tenant’s quiet enjoyment of the Premises (except as authorized under this Lease).
